On December 21, 2016, Parliament of Ukraine adopted the Law “On the High Council of Justice” that laid the foundation for organization and activity of a new constitutional body – the High Council of Justice. At the same time, some of the law’s provisions appear contrary to European standards. In particular, the law narrowed the opportunities for appealing the Council’s decisions to bring a judge to disciplinary responsibility, as well as failed to incorporate mechanisms to guarantee continuous operations of the High Council of Justice.
